Patient Terms of Service

1. Introduction and Acceptance

These Terms of Service (“Terms”) govern your access to and use of the ocuTree patient eye comfort update platform (“Platform”), operated by OcuTree Inc, a Delaware corporation (“ocuTree,” “we,” “our,” or “us”). The Platform is made available to you by your eye care provider (“Provider”) for the purpose of collecting and organizing your self-reported eye symptom information before your clinical appointments.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform. Your continued use of the Platform constitutes your acceptance of any updates to these Terms.

2. Description of the Platform

The Platform is a patient-reported symptom data collection and organization tool. It is not a medical device, diagnostic tool, clinical decision support system, or treatment recommendation service. Specifically:

  • The Platform collects your self-reported responses about eye comfort, symptom frequency, severity, and related information.
  • The Platform may collect ocular images captured by you on your personal device.
  • Your responses and images are organized and made available to your authorized eye care Provider for their review.
  • The Platform does not assess, diagnose, interpret, or provide clinical recommendations of any kind.
  • No artificial intelligence-generated clinical findings or metrics are produced or displayed to you or your Provider.
  • All clinical judgment remains solely with your licensed eye care Provider.

THE PLATFORM IS NOT FOR EMERGENCY USE. If you are experiencing sudden vision loss or a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use this Platform to report an emergency.

3. Eligibility

You must be 18 years of age or older to use the Platform independently. If you are under 18, you may only use the Platform with the involvement and consent of a parent or legal guardian. By using the Platform, you represent and warrant that you meet these eligibility requirements.

4. Your Access

Access to the Platform is provided through a unique session link generated by your eye care Provider. You should not share your session link with any other person. Each session link is specific to your appointment and expires after use or after a defined period of time. You are responsible for the accuracy of all information you submit through the Platform.

5. Patient Consent and Data Collection

By using the Platform, you consent to the collection and processing of self-reported information about your eye comfort and relevant ocular history, limited demographic information (such as age range and biological sex), visit-related details, and any ocular images you capture on your personal device, as further described in our Privacy Policy. This information is collected on behalf of your eye care Provider and is processed in accordance with our Privacy Policy and HIPAA. De-identified and aggregated data may be used by OcuTree for platform improvement, AI model development, and research. Such use will not identify you individually.

6. Ocular Images

If you capture ocular images through the Platform, you acknowledge that: (a) images are captured on your personal device and are not standardized clinical photographs; (b) images are submitted for your Provider’s contextual review and are not used for diagnosis; (c) no AI-generated clinical findings are produced from your images; and (d) images are handled in accordance with applicable HIPAA requirements.

7. Prohibited Uses

You agree not to use the Platform to: (a) report a medical emergency; (b) submit false or misleading information; (c) access another patient’s information; (d) reverse engineer the Platform; (e) transmit malicious code; or (f) use the Platform for any purpose other than submitting your own symptom information to your authorized Provider.

8. Intellectual Property

The Platform and all underlying technology are owned by OcuTree Inc and protected by applicable intellectual property laws. You receive a limited right to access and use the Platform solely for submitting your symptom information. No other rights are granted.

9. Disclaimers

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND. THE PLATFORM IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL EXAMINATION, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN WITH ANY QUESTIONS REGARDING A MEDICAL CONDITION. OCUTREE IS NOT RESPONSIBLE FOR ANY CLINICAL DECISIONS MADE BY YOUR PROVIDER BASED ON INFORMATION YOU SUBMIT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OCUTREE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OCUTREE’S TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles, except to the extent preempted by federal law including HIPAA.

12. Changes to These Terms

OcuTree may update these Terms at any time. Updated Terms will be posted at ocutree.com/terms. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.
